UK Child Car Seat and Seat Belt Rules
A guide for journeys in cars, licensed taxis, private-hire vehicles, vans and goods vehicles.
Children normally need a suitable child restraint in either a front or rear seat until they reach 135 cm or their 12th birthday, whichever comes first. After that threshold, the adult seat-belt rules apply. Specific exceptions are explained below.
The driver is responsible for making sure passengers under 14 use the restraint or seat belt required by law.
Children under 3
Travelling in a front seat
A child in the front must use the correct child car seat. Before fitting a rear-facing baby seat in the front, deactivate the front airbag. A rear-facing seat must not be used in front of an active airbag.
Travelling in a rear seat
Use an appropriate child restraint, correctly fitted for the child and the vehicle.
The licensed taxi and private-hire exception If the correct child seat is not provided in a licensed taxi or private-hire vehicle, a child under 3 may travel in the rear without a child seat or seat belt. This limited legal exception does not make an unrestrained journey as safe as using a suitable seat. Arrange a child seat in advance for a planned journey. The driver remains responsible for compliance with the applicable restraint rules.
Children aged 3 or over who are under 12 and below 135 cm
Travelling in a front seat The child must use an appropriate child restraint.
Travelling in a rear seat A suitable child restraint is normally required. It must be fitted using the approved method for that seat and vehicle.
Limited exceptions – A licensed taxi or private-hire vehicle when the correct child seat is unavailable. – An unexpected, necessary journey over a short distance. – Two child seats already fitted in the rear, with no space for a third. – A vehicle that was not fitted with seat belts. Each situation has specific conditions; see the details below.
Licensed taxis and private-hire vehicles – If the correct seat is unavailable, a child under 3 may travel only in the rear without a child seat or seat belt. – A child aged 3 or over using this exception must sit in the rear and wear an adult seat belt. Unexpected journeys When the correct child seat is unavailable, a child aged 3 or over may use an adult belt only if the journey is unexpected, necessary and short. A planned school run or airport transfer does not become unexpected merely because a seat was not arranged. The exception does not allow a child under 3 to travel without the correct seat in an ordinary car; the separate licensed taxi/private-hire exception has its own rear-seat conditions. No room for a third child seat If two child seats leave no room for a third in the rear, a child aged 3 or over may sit at the back using an adult belt. A child under 3 still needs the correct child seat and must travel in the front with that seat if necessary. Observe the airbag rules. Vehicles without seat belts Children under 3 cannot normally travel in a vehicle without a suitable child seat. A child aged 3 or over may travel in the rear without a belt where the vehicle was not fitted with one. The licensed taxi/private-hire exception is separate; none of these exceptions is a recommendation to travel unrestrained.
Children aged 12 or 13, or who have reached 135 cm
In a front seat Use the adult seat belt where fitted. In a rear seat Use the adult seat belt where fitted. The driver is responsible for compliance by children under 14. Passengers aged 14 or over They must use a fitted seat belt in either front or rear seats and are responsible for doing so themselves.

Penalties and responsibility
A driver who fails to ensure that a child uses the legally required car seat or seat belt can be penalised. The driver is responsible for making sure passengers under 14 use the required restraint.
The fine can be up to £500 if a child under 14 is not in the correct car seat or wearing the required seat belt while you drive.
An incident can also raise insurance and civil-liability questions. The outcome depends on the circumstances and policy terms; arranging the correct restraint beforehand is the practical way to protect a child.
The main reason to fit and use the correct restraint is to reduce the risk of serious injury. Check the seat, its installation and the child’s fit before starting the journey.
